Twenty-year-old David Yambasu, an unemployed youth at Samai Town Two Section in Kenema, has on January 23rd,2024, been jailed for three years by Magistrate Mustapha Briama-Jah of Magistrate Court No.2 in Kenema for larceny, contrary to Section 2 of the Larceny Act of 1916.
The particulars of offence stated that the Accused on Wednesday, December 6th, 2023 at Mende Ojeh Society Bush along David Street in Kenema, did steal Five leaves zink valued One Hundred and Twenty Five New Leones (NLe 125/00), Two shovels valued Two Hundred New Leones (NLe 2 00/00) and One (1)mental signed board valued Seven Hundred New Leones ( NLe 700/00) all to the total valued of One Thousand and Twenty Five New Leones (NLe 1,025/00), properties of Mende Ojeh Society whilst in custody of Ibrahim Kaisamba. The accused pleaded guilty and begged for mercy. He was sent to jail for three years.
Police Constable Sillah Fatmata prosecuted the matter on behalf of the State and the accused was represented by Defence Counsel, Patrick Kamara of Legal Aid Board for Kenema District.
In his ruling, Magistrate Briama-Jah, having heard from the Prosecution the fact of the case and record of the Accused and from the Defence Counsel, in his plea mitigation on behalf of the Accused who pleaded guilty for mercy, the Magistrate did not give an alternate but imposed a Custodian Sentence on the ground that Criminal conduct of any kind must not be entertained within this jurisdiction. He therefore sent the Accused to Jail at the Sierra Leone Correctional Service (SLCS) in Kenema for Three years.
