A Defendant, Baindu Kanna of Tissor village near Kenema city, has been ordered by Magistrate Court No.3 in Kenema presided over by two justices of peace, Gregory J. Lahai and Foday M. B. Koroma to pay a fine of Six Hundred New Leones ( NLe 600/00) to a complainant, Isatu Massaquoi of the aforementioned village or go to Jail for four (4) months imprisonment.
The defendant, Baindu Kanna was summoned to court for three counts. Count one, abusive language contrary to section 3(1) of the public order act no.46 of 1965, count two, public insult and provocation contrary to section two of the public order act no. 46 of 1965 and count three, for insulting conduct contrary to section 3 (1) of the public order act no. 46 of 1965.
According to prosecution, defendant, Baindu Kanna, on October 29, 2024 at Tissor village, Nongowa Chiefdom, Kenema Judicial District in the Eastern province, in public view and in the presence of the complainant, you (Baindu Kanna) did make used of abusive words against her (Isatu Massaquoi) in such a manner that would likely provoke to commit a breach of peace.
On the same date and place, the defendant did make use of insulting words to wit ” you Dae scater yourself Na Dae Area” in such a manner as would likely provoke her to commit a breach of peace.
The defendant, Baindu Kanna, pleaded not guilty but was found guilty by the court. She was fined NLe 600/00 or go to Jail for 4 months imprisonment. The fine should be given to the complainant, Isatu Massaquoi.
Before the judgement, the two JPs, having looked at the entire evidence before them, and the complainant having proved her case against the defendant beyond all reasonable doubts, the defendant was therefore found guilty on two counts and cautioned and discharged on one count. Count one, the defendant was fined NLe300/00 or go to Jail for two months imprisonment, count two, she was fined NLe300/00 or go to Jail for two months imprisonment and she was discharged on count three. “Both parties must keep peace in their community,” the court warned.
